Public Offer for Free Use of the NEMVARA Website
Version 1.0 • 19 September 2026 • English translation
Individual entrepreneur Evgeny Sergeevich Stepantsov, owner of the website https://nemvara.com, offers to enter into an agreement for free access to the publicly accessible pages of the website on the terms set out below. This offer is addressed to any person with the legal capacity to enter into such an agreement independently or through a legal representative. NEMVARA is the name of the project, not a separate party to the agreement.
1 Subject of the Agreement
1.1. The Owner enables the User to access the available website pages, including project descriptions, books, music, visual materials and contact information, and to use the navigation and available viewing and playback tools. The materials available are determined by the pages actually published.
1.2. This agreement applies to the showcase website at nemvara.com. It does not provide an account, a place in closed testing, access to paid or restricted features of individual products, a subscription covering the entire ecosystem, or a right to require the development of future features.
1.3. Free access does not include the transfer of exclusive rights or source code, individual consultations, the fulfilment of orders, or an obligation to maintain any particular page indefinitely. The terms governing the use of protected materials are set out in Section 4.
2 Cost and Absence of Sales
2.1. Access under this agreement is provided free of charge. There are no viewing fees, subscription fees, automatic charges or obligations to purchase anything. The User bears the costs of their own device and connectivity under the terms of their respective providers.
2.2. At the time this version was prepared, the NEMVARA showcase website did not provide for the purchase of goods or services. As no payments are made under this agreement, it does not establish procedures for payment, delivery of a paid order or refund of a purchase price. This does not limit lawful claims where monetary obligations arise on other grounds.
2.3. Paid offerings may be introduced only with separate terms identifying the specific product, provider, price and performance obligations. Acceptance of this offer does not constitute advance consent to such purchases. A new version cannot, by itself, turn free access already provided into a debt owed by the User.
3 Acceptance of the Offer
3.1. This offer takes effect when its full text is published on the official website and remains available for acceptance until withdrawn or replaced for new agreements. The date in the heading identifies the document version; the date of first publication is stated on the publication page.
3.2. The User may accept the offer by sending the Owner a Telegram message at @EvoBSM stating: “I accept the NEMVARA offer for free use of the website, version 1.0 dated 19 September 2026”, or an equivalent unambiguous confirmation identifying the version. The agreement is concluded when the Owner receives that message. The context of the correspondence is used to identify the sender; where reasonably necessary, the sender’s name and a representative’s authority may be clarified.
3.3. No message is required for ordinary browsing of publicly accessible pages: the Owner permits such browsing without a separate agreement. Merely opening a page, remaining silent or asking a general question about the project does not constitute acceptance of this offer. Acceptance does not replace consent to data processing or advertising where separate consent is required by law.
4 Intellectual Property Rights
4.1. Rights in original texts, graphics, photographs, music, videos, software and other protected subject matter belong to their respective rights holders. The Owner exercises only those rights that the Owner holds. Displaying a third-party component on the website does not designate the Owner as its author.
4.2. Ordinary viewing and listening through the available interface, technical caching for such use and following links are permitted. If the website itself offers a file for download, the file may be obtained for personal review within the scope of the Owner’s rights and the terms accompanying that particular file. Any broader rights under an applicable licence remain unaffected.
4.3. Without permission from the relevant rights holder or another lawful basis, protected materials may not be republished, adapted, distributed or sold, including as part of a website copy, mirror or template. Attribution or a link alone does not replace any required permission.
4.4. Statutory exceptions permitting use without permission, including lawful quotation, remain unaffected. Open licences for third-party components apply on their own terms. This agreement does not restrict rights expressly granted under those licences.
4.5. The name, logo and visual design must not be used in a way that infringes existing rights or falsely represents a third-party resource as the official NEMVARA website or a NEMVARA partner. Good-faith reviews, criticism and links do not require approval merely because they mention the project.
4.6. This agreement does not create a monopoly over ideas, general functionality or independently developed similar products, confirm trademark registration, or declare every similar domain name to be an infringement. Requests for permission should identify the specific material and intended use in a message to the Owner.
5 Acceptable Conduct
5.1. The User must not unlawfully access restricted systems, circumvent established access restrictions, interfere with the operation of the website, distribute malicious code through available channels, or impersonate the Owner or the Owner’s representative.
5.2. A description of the page and the observed problem is sufficient when reporting an error. This document does not authorise active security testing, access to other people’s data or actions that disrupt the website.
5.3. In the event of a breach or security threat, the Owner may impose proportionate restrictions on the relevant access to protect the website and other persons. A restriction may be challenged by contacting the Owner. It does not remove the User’s legal rights or the parties’ liability for actions already taken.
6 Projects and External Links
6.1. Descriptions of project areas may concern development, research, prototypes or plans. Mentioning a project does not establish that it is ready, guarantee a launch by a particular date or create an obligation to provide the described features under this agreement.
6.2. Following a link to an external website or to Telegram involves using a separate platform. Its features and terms are determined by its respective operator. A link alone does not make the Owner a party to all transactions on that platform. This provision does not exclude the Owner’s liability for the Owner’s own actions.
6.3. Arrangements for a specific service, order, licence or paid product are made separately. Information on the showcase website does not replace those terms. The legal effect of a particular offer is determined by its content and applicable law.
7 Correspondence and Personal Data
7.1. When contacting the Owner, the User independently chooses a published communication channel and provides the information necessary for their enquiry. Passwords, access keys, identity documents and other people’s personal data should not be sent without an appropriate basis.
7.2. This agreement does not authorise advertising messages, publication of correspondence, sharing it with all projects in the ecosystem or using it to train AI. Sending an idea or proposal does not, by itself, transfer exclusive rights in the attached materials.
7.3. Personal data processing must have an independent lawful basis. Its purposes, scope, retention periods, recipients and procedures for exercising rights are disclosed in a separate policy. This offer does not replace that policy or confirm that no technical information is processed when the website is visited.
7.4. If cooperation requires the exchange of confidential materials, confidentiality terms are agreed before those materials are shared. This does not displace statutory protection of personal data or other protected information.
8 Obligations and Liability
8.1. The Owner provides the free access contemplated by this agreement to materials that are actually available, receives reports of violations and corrects identified errors within the scope of applicable obligations. Continuous availability, an unchanging set of pages and the operation of external services are not guaranteed.
8.2. Informational and research materials do not promise profitability or a specific outcome from using any individual project. Merely viewing the website does not create an arrangement for individual professional services.
8.3. Each party is liable for its own actions and breaches of its obligations under applicable law. The fact that access is free does not exclude liability that cannot lawfully be excluded. This agreement does not impose arbitrary penalties or contain a blanket waiver by the User of compensation for harm or judicial protection.
9 Termination and Updates
9.1. The agreement remains in force from acceptance until termination. The User may terminate it at any time by notifying the Owner, without a fee or penalty. Termination does not extinguish claims that have already arisen or make protected materials freely available for unrestricted use.
9.2. The Owner may discontinue access under the agreement by giving the User at least 7 calendar days’ notice through the channel used for acceptance. Where required by law or in the event of an immediate security threat, necessary restrictions may be imposed immediately, with notice when possible and permissible.
9.3. A new version applies to new agreements following publication. Changes to an existing agreement require a basis provided by law or the parties’ agreement; ordinary visits to the website are not treated as consent to all future changes. The previously accepted version and the correspondence recording acceptance may be used to establish the terms of the relationship.
